If you are a Social Networking Site provider, you must:

• Provide the users with clear information about your identity, what information you collect from the users and how you intend to use this information;
• Specify the extent to which other users will have or may have access to a user’s information having also regard to the user’s age; and provide a user-friendly way for users to adjust their security defaults with particular safeguards for minors;
  • In particular, in the event of minors, you will need to adopt technical measures which allow you to identify the age of the user;
  • Make safety information readily accessible to the users and/or their parents;
  • Have links in place allowing users to report abuse;
  • Ensure that the default setting for under 18s safeguard the privacy of the users;
  • Provide users with easy to understand guide on how to use a Social Networking Site.
• Provide users with privacy warnings (not only in the privacy policy and terms of use, but throughout the site) as may be appropriate;
• Advise about the risk and your rights if a user uploads content (including photos) of third parties and address copyright and consent issues (again not only in the necessary documents but throughout the site) as may be appropriate including by adopting additional terms in the event you operate forums or other User-Generated pages or blogs;
• Include clear statements that you do not condone, encourage or tolerate copyright infringement;
• Provide a complaints procedure with guidance on how a user can place a complaint and adopt the relevant procedures;
• Act promptly in the event of a complaint and ensure you have in your agreements with users, advertisers and other third parties reserved the appropriate rights.
