The words "trademark" and "brand" are often used interchangeably. Both refer to signs which are used by traders to differentiate their goods from those of other traders. One common definition of "brand" is a "mark made by a hot iron", in other words, a means for one herdsman to "mark" his animals and so distinguish them from those of his neighbour. More simply, branding is a way of saying "this is mine". Corporate takeover battles often centre on the value of the brands at stake and so highlight their commercial value. Brands can even account for a majority of a company's assets. In a recent survey of the world's most valuable brands, the value of the top ten brands ranged from around US$27 billion to US$70 billion.

  • Adopt marks that are not usually associated with the goods or services you sell.
  • Before applying for a trademark carry out a trade mark clearance and internet search to ensure that your proposed mark is not already used by another company. 
  • Seek registrations for trademarks in all (major) jurisdictions in which the website owner or its licensees carry on or intend to carry on business. Include trademark notices next to the relevant trademarks (® for registered trademarks and ™ for unregistered trademarks).
  • Do not use third party trademarks, logos, names unless you have a licence to do so.
  • Do not be afraid to take action against an infringer but be careful not to make unjustified threats.
