BRIEF:

To successfully resist and defend a claim for international patent infringement within a very tight timescale of five working days! To turnaround the situation and achieve some good results without major costs nor litigation.

SOLUTION:

First of all, I had to carry out a risk assessment of the ip situation for my client. Then I had to make sure that the other party knew that my client knew its rights and also I had to present my client's position to be as strong as possible so that requests for a royalty-free licence could be dismissed. Very heated conference calls followed which showed determination and skill. Succeeded in negotiating a reasonable patent licence that not only recognised my clients right but also provided for royalties. Obtained cross licence for my client for the claimants technology opening the fields of intellectual property exploitation for my client.

RESULT:

Mission accomplished. Instructed Monday evening. Licence completed by Friday afternoon. No litigation and at minimum cost. Achieved a royalty bearing licence and cross-licence for my client.
